Terms of service
Last updated 9 August 2026. This page describes the terms of the Tenderco web partnership.
1. The service
Tenderco provides an ongoing, fixed-fee web partnership: design, WordPress development, hosting, security, content and CMS support, payments and automations, and managed SEO, delivered as unlimited requests worked one active request at a time. There is no project end date. Full inclusions are listed on the Pricing page.
2. Fees and billing
The public rate is $1,100 per month. Registered not-for-profits are billed $850 per month once eligibility is verified (see Not-for-profits). Fees are billed monthly in advance via Stripe. The public rate is the only rate available to for-profit direct customers — it is not discounted or negotiated on request. Price changes are communicated 30 days in advance; the payment method on file is authorised for recurring and any early-termination charges.
3. Minimum term
The partnership has a 12-month minimum term, measured from the start date. The minimum term resets whenever major works are delivered (such as a platform migration or redesign). A payment method on file is required for the full minimum term at signup. For accounts suspended for non-payment (after 7 days overdue and 3 contact attempts), the remaining balance for the unexpired minimum term becomes payable.
4. Cancellation
Customers may cancel with 30 days written notice after the minimum term has expired. Early termination during the minimum term requires payment of the remaining balance for that term. On cancellation, the site, its content, and the domain remain the customer's property — Tenderco hands over all access cleanly with no withholding.
5. What "unlimited" includes and excludes
Unlimited requests are genuine, throttled by working one active request at a time in the customer's priority order. The following mirrors the Pricing page and is the enforceable version of that scope:
Included: new pages and content · design changes and full redesigns · platform migrations and takeovers · integrations with standard services · bug fixes and performance work · SEO strategy and implementation.
Not included: custom web applications and bespoke software · native mobile apps · third-party licence fees and ad spend · content creation at volume (photography, video, long-form copywriting) · e-commerce beyond 3 products · 24/7 on-call response. Work outside these inclusions will be quoted separately and agreed before starting, or declined if it falls outside what Tenderco offers.
6. Service commitments
Security patches are applied within 7 days of release; critical vulnerabilities are mitigated within 48 hours. Customer sites are backed up daily with 30-day retention, and hosted in Australia (Google Cloud, Melbourne — australia-southeast2). Routine maintenance is performed in a weekly Saturday window.
7. Ownership and intellectual property
The website, its content, and the domain belong to the customer at all times. On cancellation, Tenderco hands over site and domain access cleanly. The customer owns the materials they supply; Tenderco retains ownership of its pre-existing methods, templates, and tooling used to deliver the work.
8. Not-for-profit verification
The not-for-profit rate is available to registered charities (ACNC-registered), incorporated associations and not-for-profit entities, community organisations and sporting clubs, and religious organisations with NFP status. Tenderco verifies ABN and registration details after signup; if eligibility cannot be confirmed, the standard $1,100 rate applies. Social enterprises structured as for-profit companies, B-Corps, and for-profit-registered organisations with a charitable mission are not eligible.
9. Partner program terms
Partners are paid in dollars, not as a percentage of the customer's subscription. At the current rate card: partners earn $255 per referred client per month at the Active tier (2+ new clients/month, rolling 3-month average), $170 per client per month at the Standard tier (1+/month), and $85 per client per month at the Floor tier (below 1/month) — the floor does not go lower. These rates apply to Tenderco's base rate, not the customer's price. The customer's price is always $1,100 per month regardless of the referring partner's tier. Commission is paid monthly in arrears on clients in good standing, with no cap and no expiry on attribution. Not-for-profit referrals are not commissionable, as there is no partner margin in that rate. Partners may leave the program at any time; trailing commissions on their referred clients stop on exit.
10. Defects
Defects in delivered work must be flagged within 5 business days of delivery. Valid defects are remedied within a reasonable time at no additional cost.
11. Liability
Tenderco's total liability under these terms is capped at the fees paid by the customer in the 12 months preceding the claim.
12. Changes to these terms
Changes to these terms are communicated 30 days in advance via email to the address on file. Continuing the partnership after that period constitutes acceptance of the revised terms.
13. Governing law
